Nebraska PSC to Investigate Political Phone Calls

The Nebraska PSC decided to investigate consumer complaints about annoying anonymous automated political phone calls the weekend before the 2006 election campaigns that apparently targeted former congressional candidate Scott Kleeb (D), who lost to state Sen. Adrian Smith (R) in the state's 3rd congressional district. Consumers complained about receiving repeated calls very early in the morning or very late at night, playing a poor-quality recording of Kleeb's voice seeking their vote. The calls didn't identify their source. They appear to have violated state and federal telemarketing rules. Neb. telemarketing rules require users of automated dialing and announcing equipment to obtain a permit, restrict calls to certain hours, and identify the source of the calls. FCC telemarketing rules also require autodialer users to identify who's placing calls. Although the Kleeb campaign used automated calling, managers said they adhered to all applicable rules. Smith campaign managers said they didn't use Kleeb's voice in any political campaign calls.
